By accessing or using the Path to Plate platform, you, the “User”, acknowledge and agree to comply with the following Terms and Conditions.
Release of Liability
Path to Plate Users hereby release, waive, discharge, and covenant not to sue Path to Plate, its affiliates, officers, employees, agents, partners, and licensors (collectively, "Path to Plate") from any and all liabilities, claims, actions, damages, costs, or expenses of any nature whatsoever arising out of or in any way connected with the usage of the platform. Users of Path to Plate understand and agree that this release includes any claims based on the actions, omissions, or negligence of Path to Plate, whether liability arises in contract, negligence, tort, under the statute, in equity, at law, or otherwise.
Voluntary Agreement
Users that so choose to enter into an agreement, transactional or otherwise, affirm that they are entering into any such agreement voluntarily and at their own will, and not as a result of any representations, promises, statements, or inducements made by Path to Plate. Users acknowledge that they are fully aware of the nature and extent of the rights they are releasing and the possible consequences of such release.
Indemnification
Users agree to indemnify, defend, and hold harmless Path to Plate from any and all claims, liabilities, damages, losses, costs, and expenses (including, without limitation, attorneys' fees) arising from or in connection with Path to Plate.
Entire Agreement
These Terms and Conditions constitute the entire agreement between the Path to Plate and its Users with respect to the subject matter hereof and supersedes all prior or contemporaneous oral or written agreements and understandings between Users in relation to such subject matter.
Governing Law
The Users' agreement with these Terms and Conditions shall be governed by and construed in accordance with the laws of New Mexico without giving effect to any choice or conflict of law provision or rule.
Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect. By accepting these Terms and Conditions below, you, the User, acknowledge that you have read and understand the Terms and Conditions and agree to be bound by its terms.
